Welcome to Solo Expression LLC ("Solo Expression," "we," "us," or "our"). These Terms of Service ("Terms") govern your use of our website at soloexpression.com, participation in our dance classes, dance therapy sessions, adaptive programming, workshops, and community events, as well as any purchases made through our online store. By accessing our website, enrolling in our programs, or purchasing our products, you agree to be bound by these Terms.

1. ELIGIBILITY AND ENROLLMENT

General Enrollment

Solo Expression offers dance instruction, dance therapy, and adaptive movement programming for individuals of all ages and abilities. Enrollment in any program requires the completion of a registration form and, where applicable, a signed participation waiver.

Minor Participants

Participants under the age of 18 must have a parent or legal guardian complete all registration materials and sign all required waivers on their behalf. The parent or guardian assumes responsibility for the minor's participation and agrees to these Terms on the minor's behalf.

Waiver-Funded Participants

Solo Expression accepts Fee-for-Service (FSS) and Intellectual and Developmental Disabilities (IDD) waivers. Enrollment through waiver funding requires coordination with the participant's authorized service coordinator or case manager. Solo Expression will work directly with the authorized agency to confirm eligibility, service authorization, and documentation requirements. Waiver-funded services are subject to the terms and conditions established by the authorizing agency in addition to these Terms.

2. PARTICIPATION WAIVERS AND ASSUMPTION OF RISK

All participants (or their parent/guardian) must sign a Liability Waiver and Release Form before participating in any Solo Expression activity, including studio classes, on-site sessions, Zoom classes, community workshops, and performance events. By signing the waiver, you acknowledge that:

• Dance and physical movement involve inherent risks including but not limited to physical injury, fatigue, and exertion.
• Solo Expression takes reasonable precautions to ensure participant safety, including tailored instruction for individuals with disabilities and physical limitations.
• You voluntarily assume all risks associated with participation.
• You release Solo Expression LLC, its founder Anthony "Solo" Harris, instructors, staff, and volunteers from liability for injuries sustained during participation, except in cases of gross negligence or willful misconduct.

Waivers remain on file for the duration of enrollment. A new waiver may be required for special events, field trips, or performance activities.

3. CLASS AND SESSION POLICIES

Scheduling and Attendance

• Class schedules are posted on our website and communicated via email. Solo Expression reserves the right to modify schedules, substitute instructors, or cancel classes due to circumstances beyond our control.
• On-site sessions at partner facilities (schools, care centers, community organizations) are scheduled by mutual agreement between Solo Expression and the host organization.
• Zoom classes require a stable internet connection. Solo Expression is not responsible for technical difficulties on the participant's end.

Cancellation and Refund Policy

• Monthly Dance Pass: Non-refundable once the billing period begins. Passes may not be transferred to another individual without prior approval.
• Private Sessions and Coaching: Cancellations must be made at least 24 hours in advance. Late cancellations and no-shows may forfeit the session fee.
• Workshops and Special Events: Refund eligibility is determined on a case-by-case basis. Requests must be submitted in writing to soloexpressionspa@gmail.com.
• Waiver-Funded Services: Cancellation and billing for FSS/IDD waiver-funded sessions follow the policies of the authorizing agency.

Code of Conduct

Solo Expression maintains a respectful, inclusive, and safe environment for all participants. We expect all participants, parents, guardians, and visitors to:

• Treat fellow participants, instructors, and staff with dignity and respect.
• Follow instructor guidance and safety protocols during all activities.
• Communicate any health changes, concerns, or incidents to staff promptly.
• Refrain from any form of harassment, discrimination, or disruptive behavior.

Solo Expression reserves the right to remove any individual from a program or the premises if their behavior threatens the safety or well-being of others, with no refund obligation in such cases.

4. PHOTOGRAPHY, VIDEO, AND MEDIA

Solo Expression may photograph or video record classes, workshops, performances, and events for promotional, educational, and archival purposes. By participating, you consent to the use of your (or your child's) likeness in marketing materials, social media, website content, and publications unless you have submitted a written opt-out request.

For participants who are minors or individuals under guardianship, media consent is included in the enrollment waiver and must be signed by the parent or legal guardian. Opt-out requests may be submitted at any time to soloexpressionspa@gmail.com.

5. ONLINE STORE AND PURCHASES

Solo Expression offers merchandise, digital products (including the Dance Progress Planner), affirmation cards, apparel, and coaching services through our website. By making a purchase, you agree to the following:

• All prices are listed in U.S. dollars. Applicable taxes and shipping charges are calculated at checkout.
• Payment is processed securely through our third-party payment provider. Solo Expression does not store credit card information on our servers.
• Digital Products: All digital product sales (PDFs, downloads, printables) are final. No refunds are issued for digital goods once delivered.
• Physical Products: If a physical item arrives damaged or incorrect, contact us within 14 days of delivery at soloexpressionspa@gmail.com for a replacement or exchange.
• Coaching Services: Dance Career and Life Coaching sessions are subject to the scheduling and cancellation policies in Section 3.

6. INTELLECTUAL PROPERTY

All content on the Solo Expression website — including but not limited to the Solo Expression name, logo, infinity symbol mark, mascot character, class curricula, dance therapy methodologies, the Dance Progress Planner, "Evolving Disabilities" tagline, and all written, visual, and multimedia content — is the property of Solo Expression LLC and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Solo Expression content without express written permission. The Solo Expression dance therapy methodology, developed by founder Anthony "Solo" Harris, is proprietary and may not be replicated, taught, or commercially adapted without a formal licensing agreement.

7. DONATIONS

Solo Expression accepts charitable donations through our integrated donation platform (currently Zeffy). Donations support our mission to provide accessible dance programming to underserved communities. All donations are voluntary, and tax-deductibility depends on Solo Expression's tax-exempt status and applicable IRS regulations. Donation processing is subject to the third-party platform's own terms of service.

8. CHAPTERS AND EXPANSION

Solo Expression may establish chapter locations in additional communities. Individuals or organizations interested in operating a Solo Expression chapter must submit a formal Chapter Request and enter into a licensing agreement with Solo Expression LLC. Chapter operators are bound by Solo Expression's quality standards, brand guidelines, and operational requirements as defined in the chapter agreement.

9. LIMITATION OF LIABILITY

To the fullest extent permitted by Pennsylvania law, Solo Expression LLC, its founder, officers, instructors, staff, volunteers, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, participation in our programs, or purchase of our products. Our total liability for any claim shall not exceed the amount you paid for the specific service or product giving rise to the claim.

10. INDEMNIFICATION

You agree to indemnify and hold harmless Solo Expression LLC, Anthony "Solo" Harris, and their respective agents, employees, and partners from any claims, damages, liabilities, costs, or expenses (including attorneys' fees) arising from your violation of these Terms, your participation in programs, or any misrepresentation you make in connection with your enrollment or use of our services.

11. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any disputes arising from these Terms or your relationship with Solo Expression shall be resolved in the courts of Northampton County, Pennsylvania. Before initiating any formal legal action, both parties agree to attempt good-faith resolution through direct communication.

12. CHANGES TO THESE TERMS

Solo Expression reserves the right to update or modify these Terms at any time. Material changes will be communicated through our website with an updated Effective Date. Continued use of our website or participation in our programs after changes are posted constitutes your acceptance of the revised Terms.
